Please read these Terms of Service carefully before using the website or services provided by Empower AI 365. By using our site or engaging our services, you agree to these terms.

1. Acceptance of Terms

  • By accessing our website or engaging with any service offered by Empower AI 365, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, please do not use our services.

2. Description of Services

  • Empower AI 365 provides AI-powered growth and automation services including, but not limited to, outbound lead generation, AI sales development, sales call analysis, and revenue acceleration consulting (collectively, the 'Services').
  • The scope, deliverables, and fees for specific engagements are defined in separate service agreements or statements of work between Empower AI 365 and the client.

3. Client Responsibilities

  • You agree to provide accurate, current, and complete information as required for service delivery.
  • You are responsible for maintaining the confidentiality of any credentials or access provided in connection with the Services.
  • You agree not to use our Services for any unlawful purpose or in any way that violates applicable regulations including, but not limited to, anti-spam laws (CAN-SPAM, CASL, GDPR).

4. Intellectual Property

  • All content, branding, methodologies, and systems created by Empower AI 365 remain the intellectual property of Empower AI 365 unless explicitly transferred in writing.
  • Client data and materials provided to us for service delivery remain the property of the client. We do not claim ownership of client-supplied content.

5. Payment Terms

  • Payment terms are defined in the applicable service agreement. Unless otherwise agreed, invoices are due within 15 days of issuance.
  • Empower AI 365 reserves the right to suspend services for overdue accounts. Late payments may be subject to interest charges as specified in the service agreement.

6. Confidentiality

  • Both parties agree to keep confidential any proprietary information disclosed during the course of the engagement and not to disclose such information to third parties without prior written consent, except as required by law.

7. Limitation of Liability

  • To the maximum extent permitted by law, Empower AI 365 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Services.
  • Our total liability for any claim arising under these Terms shall not exceed the total fees paid by you to Empower AI 365 in the three months preceding the claim.

8. Disclaimer of Warranties

  • Our Services are provided 'as is.' While we take pride in delivering measurable results, we do not guarantee specific revenue outcomes, lead volumes, or conversion rates. Individual results vary based on market conditions, product-market fit, and factors outside our control.

9. Termination

  • Either party may terminate an engagement as specified in the applicable service agreement. Upon termination, client data will be returned or securely deleted within 30 days at the client's request.

10. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through good-faith negotiation, followed by binding arbitration if necessary.

11. Changes to These Terms

  • We reserve the right to update these Terms at any time. Material changes will be communicated via email or through a notice on our website. Continued use of our Services following such notice constitutes acceptance.
